Terms of Service
1. Who we are. OneEye is a software service operated by [LEGAL ENTITY NAME], a company incorporated in India, CIN [XXXX], registered at [ADDRESS] ("OneEye", "we"). By creating an account you agree to these terms.
2. What the service does. OneEye accepts photographs of a construction or interior fit-out site that you upload or authorise, applies computer vision and machine learning to estimate the physical progress of defined work items, and compares visible work against a specification you provide. It returns a dated progress record, a list of possible defects, and a list of apparent deviations from your specification.
3. What the service does not do. OneEye produces informational estimates. It is not a certification, inspection, survey, valuation, or engineering opinion. It does not replace a licensed engineer, architect, or statutory inspector. It does not execute payments, impose penalties, terminate contracts, or take any action against any person. Every decision arising from a OneEye output is yours.
4. Accuracy and human review. Machine vision output is probabilistic. Estimates and flags may be incorrect, incomplete, or missing. You must not rely on a OneEye output as the sole basis for releasing payment, accepting handover, rejecting work, alleging breach of contract, or making any claim against any person. You agree to independently verify any finding before acting on it.
5. Your responsibilities. You warrant that: you have the legal right to photograph the site and to upload those photographs; you have given every person working at the site written notice that photographs are being captured and analysed, and for what purpose; and your use complies with the Acceptable Use Policy at /acceptable-use, which forms part of these terms.
6. Your content. You retain all rights in the photographs, drawings, and specifications you upload. You grant us a limited licence to process them solely to provide the service to you. We do not use your site media to train models shared with other customers unless you give separate written opt-in, which is off by default and revocable at any time.
7. Fees. Fees are as published at /#pricing, exclusive of GST. Project fees are charged on project creation. Subscription fees are charged monthly in advance. See /refunds.
8. Suspension and termination. We may suspend or terminate an account for non-payment, for breach of these terms, or for breach of the Acceptable Use Policy. Where an account is used for prohibited surveillance, we will terminate without refund and without notice.
9. Liability. To the maximum extent permitted by law, our total aggregate liability for any claim is limited to the fees you paid us in the three months preceding the claim. We are not liable for indirect, consequential, or incidental loss, including construction cost overruns, project delay, rework cost, lost profit, or any dispute between you and a contractor, designer, worker, or owner.
10. Indemnity. You indemnify us against claims arising from your upload of material you had no right to upload, from your failure to give the notice required by clause 5, or from your use of the service in breach of the Acceptable Use Policy.
11. Governing law. These terms are governed by the laws of India. Courts at [CITY], India have exclusive jurisdiction.
